These Terms of Service (“Terms”) govern your use of Rate My Birth Care, including the websites at ratemydoulas.com and ratemymidwifes.com (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements and that the information you provide is accurate.

Some features require an account. We verify your email address before you can post a review. You are responsible for the activity under your account and for keeping your credentials secure. Provide accurate information and keep it up to date.

You may post reviews only of providers you personally worked with, and your content must follow our Community Guidelines. You are solely responsible for the content you submit and represent that it is truthful and based on your own experience.

We may remove, edit, or refuse to publish any content that violates these Terms or our guidelines, or that we believe is unlawful, fraudulent, or harmful — with or without notice.

You retain ownership of the content you submit. By posting it, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to host, store, display, reproduce, and distribute that content in connection with operating and promoting the Service.

• Posting false, defamatory, or misleading reviews, or reviews you were paid to write.
• Reviewing your own business or a competitor’s business.
• Impersonating any person or misrepresenting your affiliation with anyone.
• Scraping, harvesting, or bulk-collecting data from the Service.
• Interfering with, disrupting, or attempting to gain unauthorized access to the Service.
• Using the Service for any unlawful purpose or in violation of these Terms.

Provider profiles may be created from publicly available information so families can find and review them. Providers may claim their profile and complete verification to manage it. If you are a provider and need a correction, reach us through our contact page. Listing a provider does not imply any endorsement, affiliation, or relationship between that provider and us.

We offer paid services to providers, such as sponsored placement, lead delivery, and subscription features. Fees, billing intervals, and what each service includes are described at the point of purchase. Unless required by law or stated otherwise, payments are non-refundable. We may change our pricing and offerings on a going-forward basis.

The Service provides a platform for sharing and reading reviews. It does not provide medical advice, and nothing on the Service is a substitute for professional medical care. Reviews reflect the individual opinions and experiences of the people who wrote them and do not represent our views.

We are not affiliated with, and do not endorse, certify, or guarantee, any provider listed on the Service. The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including accuracy, reliability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, Rate My Birth Care and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the twelve months before the claim.

You agree to indemnify and hold harmless Rate My Birth Care and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms.

These Terms are governed by the laws of the State of [GOVERNING-LAW STATE], without regard to its conflict-of-law rules. You agree that any dispute arising from these Terms or the Service will be brought in the courts located there, unless applicable law provides otherwise.
